Antitrust Run Amuck

The U.S. federal government has brought many ridiculous antitrust lawsuits, but this one is one of the stupidest. They are going to court to block the propsed merger between Whole Foods Market and Wild Oats, saying this would monopolize the retail health food industry:

When the U.S. government goes to court this week to try to block Whole Foods Market Inc.'s planned purchase of Wild Oats Markets Inc., the judge will wrestle with this question: Which of John Mackey's arguments is most convincing?
The Federal Trade Commission contends Whole Foods and Wild Oats operate in a distinct market for premium natural and organic groceries and the $565 million deal would curtail competition and raise prices in that segment. To make its case, the agency is relying on comments by Mr. Mackey, the chief executive of Whole Foods, which suggest he considers his company's playing field different than that of typical grocers.
"Safeway and other conventional retailers will keep doing their thing -- trying to be all things to all people," Mr. Mackey has said, according to the FTC. "They can't really effectively focus on Whole Foods' [clientele]."

To see just how ridiculous this lawsuit is, compare the 2006 sales revenue of Whole Foods and Wild Oats with some of their competitors in retail grocery:

Whole Foods $5.6 billion

wild Oats 1.2 billion

Safeway 40.2 billion

Kroger 66.1 billion

A&P 6.8 billion

And this list doesn't even include Walmart, nor Target. (I scanned their annual reports but was unable to determine what portion of their sales are derived from groceries.)

It is ludicrous for the government to worry about the acquisition of a grocery chain that has less than one percent of the total sales in the USA. It is time that the government stayed out of business affairs altogether. They should stick to enforcing contracts and enforcing the criminal laws, especially the immigration laws. And try to protect the country from foreign enemies, include illegal immigrants.

The "liberals" at Moveon.org and Daily Kos have begun a campaign against Fox News channel by targeting their advertisers:

NEW YORK (AP) - Liberal activists are stepping up their campaign against Fox News Channel by pressuring advertisers not to patronize the network.
MoveOn.org, the Campaign for America's Future and liberal blogs like DailyKos.com are asking thousands of supporters to monitor who is advertising on the network. Once a database is gathered, an organized phone-calling campaign will begin, said Jim Gilliam, vice president of media strategy for Brave New Films, a company that has made anti-Fox videos.

The left are so accustomed to having a monopoly on mass communications of national political events that they CAN'T STAND the fact that Fox and the blogosphere exist. It's perfectly ok with them that CBS ABC NBC CNN and the New York Times, Washington Post, etc, etc, etc, have extreme leftwing bias.

"We're not trying to silence anybody," Green said. "Rush Limbaugh has a right to be on the air—he admits his point of view. Fox doesn't."

They think that anything a conservative or libertarian says or does constitutes a hatecrime. If it were up to them, people like me would be thrown in prison or executed. The paper said that "Harry Potter" was a Zionist project in which billions of dollars had been invested in order to disrupt the minds of young people.

U.S. District Judge James Munley Says its Illegal to Crack Down on Illegals

Once again, we have a leftwing judge legislating from the bench. U.S. District Judge James Munley struck down the Illegal Alien Relief Act of Hazleton Pennsylvania:

ALLENTOWN, Pa. --A federal judge on Thursday struck down the city of Hazleton's tough crackdown on illegal immigrants, ruling unconstitutional a law that has been emulated by towns and cities around the nation.
The Illegal Immigration Relief Act, pushed by the city's Republican mayor last summer after two illegal immigrants were charged in a fatal shooting, was voided by U.S. District Judge James Munley following a nine-day trial in March.
The decision will almost certainly be appealed by the city.
Hazleton had sought to impose fines on landlords who rent to illegal immigrants and deny business permits to companies that give them jobs. A companion measure would have required tenants to register with City Hall and pay for a rental permit.
Mayor Lou Barletta, chief proponent of the crackdown, contends illegal immigrants have brought drugs, crime and gangs to the city of more than 30,000, overwhelming police, schools and hospitals.

Now get a load of the reasoning of the judge and the plaintiffs in the case:

Hispanic groups and illegal immigrants sued in federal court to overturn the measures, saying they usurp the federal government's exclusive power to regulate immigration, deprive residents of their constitutional rights to equal protection and due process, and violate state and federal housing law.
In a 206-page opinion, Munley said the act was pre-empted by federal law and violated the plaintiffs' due process rights.
"Whatever frustrations ... the city of Hazleton may feel about the current state of federal immigration enforcement, the nature of the political system in the United States prohibits the city from enacting ordinances that disrupt a carefully drawn federal statutory scheme," Munley wrote.
"Even if federal law did not conflict with Hazleton's measures, the city could not enact an ordinance that violates rights the Constitution guarantees to every person in the United States, whether legal resident or not," he added.

First of all, if illegal aliens show up in a U.S. District Court to file a lawsuit, why wasn't the Border Patrol called so that they could be apprehended and deported? In addition, since when does the constitution guarantee any illegal alien the right to employment in the U.S., and where does it guarantee illegal aliens the right to rent an apartment?

There are no constitutional guarantees of rights to illegal aliens. They only right they have is for a one-way ticket out of the country.

I wonder who appointed James Munley to the bench? Was it Carter or Clinton?

Update: Munley was appointed on October 26, 1998. That means he was appointed by Clinton! For that matter, Hillary had a major role in selecting judges for the federal courts. If she gets elected president, we may look forward to many more of these looney jurists.

Do Gold and Silver Prices Track Expected Inflation?

Former U.S. Federal Reserve Board Chairman Alan Greenspan (1993) mentioned the price of gold as an indicator of expected inflation:

Moreover, inflation expectations, at least by some measures, appear to have tilted upward this year, possibly contributing to price pressures. The University of Michigan survey of consumer attitudes, for example, reported an increase in the inflation rate expected to prevail over the next 12 months from about 3.75 percent in the fourth quarter of last year to nearly 4.5 percent in the second quarter of this year. Preliminary data imply some easing of such expectations earlier this month, but the sample from which those data are derived is too small to be persuasive. Moreover, the price of gold, which can be broadly reflective of inflationary expectations, has risen sharply in recent months.

As I recall, Greenspan was widely ridiculed for using the price of gold as an indicator of expected inflation. Back then there was no direct method of estimating expected future inflation. But beginning in 1997 the U.S. Treasury began issuing the Treasury Inflation Protected Securities (TIPS) whose principal are indexed to the Consumer Price Index. We can estimate investors' inflation expectations by subtracting the yield on a TIPS bond from the yield of a nominal U.S. Treasury bond of the same maturity.
The black line at the bottom of the above graph is our estimate of the inflation expectations over a 5 to 10 year horizon for each month from 1997 to 2006. Above that are the spot prices of gold and silver bullion. You can easily see the co-movements between the metals prices and inflation expectations, except for the period beginning in September, 2005 when the metals increased rapidly in value without any corresponding increase in expected inflation.

The widely anticipated move marks Starbucks' second price increase in less than a year and comes a month after the coffee shop chain's chief financial officer warned it would be "very challenging" for Starbucks to meet the high end of its 2007 earnings forecast, in part because of rising dairy prices.

Tiger Woods Hits Ulster Scot Woman with Golf Ball

CARNOUSTIE, Scotland — A woman was hit in the head by Tiger Woods' ball when he sliced an approach at the British Open on Saturday. She needed two stitches to close the wound.
Jennifer Wilson, from Antrim, Northern Ireland, was treated by medical staff after being driven away in a golf cart. Woods had earlier apologized and given the 63-year-old an autographed glove.
Wilson was struck just short of the green at the par 5 sixth hole at Carnoustie, where she was standing with her husband.
"We were standing 30 yards short of the green and I said to Jennifer: 'Get your crash helmet on, Tiger's coming,'" Cecil Wilson said. "I could not believe it when Jennifer then got 'clunked,' but he does go off line from time to time. She just sank to her knees and we laid her down flat. She's had two stitches and there was quite a lot of blood. A guy in the crowd said he was a doctor, but to be honest we didn't really need him.

I tried to get into golf when I was younger, but couldn't quite hack it. It is very difficult and I find it dull. There's nothing to compare with hunting wild pheasant or quail over a Springer Spaniel.

My dad loved golf. That's all he ever did in his free time.

Producer of 'Great Global Warming Swindle' Talks About the Fatwa Placed on Him

Martin Durkin, who made a documentary that questioned much of the global warming dogma, has been subjected to intense personal attacks. He was ready for this, because we are constantly hearing about how anyone who doubts that global warming is caused by human CO2 emissions must be either stupid or on the payroll of ExxonMobil or Halliburton.

Martin talks about his experiences and has some interesting insights as to why the global warming faithful are so intolerant and vindictive:

Why are the global warmers so zealous? After a year of arguing with people about this, I am convinced that it's because global warming is first and foremost a political theory. It is an expression of a whole middle-class political world view. This view is summed up in the oft-repeated phrase "we consume too much". I have also come to the conclusion that this is code for "they consume too much". People who believe it tend also to think that exotic foreign places are being ruined because vulgar oiks can afford to go there in significant numbers, they hate plastic toys from factories and prefer wooden ones from craftsmen, and so on.
All this backward-looking bigotry has found perfect expression in the idea of man-made climate disaster. It has cohered a bunch of disparate reactionary prejudices (anti-car, anti-supermarkets, anti-globalisation) into a single unquestionable truth and cause. So when you have a dig at global warming, you commit a grievous breach of social etiquette. Among the chattering classes you're a leper.

Above all, the denizens of the left simply can't stand it when someone expresses ideas that clash with their own. In spite of all their claims to being 'open-minded', and their use of the oxymoronic 'liberal' moniker, they are the most intolerant, bigoted, and narrow-minded people in the world.

Blacks in U.S. imprisoned at 5 times the rate of whites

According to a criminal justice policy group, this is a racial injustice:

DES MOINES, IOWA — Blacks in the United States are imprisoned at more than five times the rate of whites, and Hispanics are locked up at nearly double the white rate, according to a study released Wednesday by a criminal justice policy group.
The report by the Sentencing Project, a Washington-based think tank, found that states in the Midwest and Northeast have the greatest black-to-white disparity in incarceration. Iowa had the widest disparity in the nation, imprisoning blacks at more than 13 times the rate of whites.
Such figures "reflect a failure of social and economic interventions to address crime effectively," as well as racial bias in the justice system, said Marc Mauer, the group's executive director.

You are asking the wrong question, Mr. Mauer. What you should research is: What percentage of blacks who commit crimes get convicted and incarcerated vs. white and hispanics? If blacks commit five times as many crimes, then it stands to reason that they should be incarcerated five times as often.

The former US vicepresident provided 75 guests with Chilean sea bass - one of the world's most threatened fish species.
Gore, 59, who created the climate change documentary An Inconvenient Truth, sampled a sixcourse tasting menu at Beverly Hills' Crustacean restaurant which included the sea bass - also known as Patagonian toothfish.

Also known as Patagonian toothfish, the species is under huge pressure from illegal, unregulated and unreported fishing activities in the Southern Ocean, jeopardising the sustainability of remaining stocks.
It is known as one of the world's most endangered species of fish. Evidently a fact not known by the Gores.

After I crossed over it, if I were to come back I would be arrested.I was shocked, I’ve never even gotten a speeding ticket in my life.
